These Terms of Service govern your use of the Concours Pro software application, operated by Juice Digital Pty Ltd, ACN 622 492 700 (‘Juice Digital’) and available at ConcoursPro.app.
By subscribing to, taking a free trial of, accessing or using Concours Pro, you agree to be bound by these Terms of Service.
1. Marketing Permissions
- By subscribing to Concours Pro you consent to receive SMS/email notifications & marketing communication from Juice Digital.
- Message frequency varies & data rates may apply. Text HELP to +61483959777 for help, or text STOP to unsubscribe.
- Click the unsubscribe link in emails to unsubscribe.
2. Subscription & Payment Terms
2.1 Subscription-Based Service
- Concours Pro is a subscription-based service with a monthly access fee, which grants users access to the platform.
- Users may subscribe at the standard rate or, from time to time, may be offered a discounted rate in exchange for a minimum commitment period (e.g., as part of a Custom Account Setup offer).

2.2 Paid Features / Usage Rates
- Concours Pro offers paid features, billed per use (Hereafter referred to as ‘Usage’). These include monthly phone number rental, voice calls – incoming and outgoing, call forwarding, call recording and storage, number validation, spam detection, name lookup, SMS sending and receiving (per 160 character SMS segment), email sending, email validation, auto-complete address, automation workflow premium triggers and actions, and all AI features.

- Our platform partners are USA based, so for transparency, all usage rates are published in US Dollars, then converted to Australian dollars at the current real time exchange rate, as published at xe.com, on the date/time of invoicing.
- Usage will be invoiced (plus GST) on the first of every month, with the invoice due in 14 days. The current real time exchange rate will be noted on all usage invoices.
- If usage invoices total over $400 AUD monthly, we reserve the right to switch to fortnightly or weekly usage billing.
- We may include limited free usage on certain features, or usage credits in free trials or certain levels of subscription. As of the date above, we provide $20.00 AUD of usage credit in all free trials.
- Usage charges greater than any included credits or free usage limits will be billed via monthly invoice to the user on the first of the month.
- Should usage charges in a free trial exceed the included credits and free usage limits, your usage will be billed to you in the normal manner. On occasion, we may offer additional credits for your free trial, at our discretion.
- Should usage charges in a free trial be less than the included credits, the unused credit balance will roll over to be used against future usage.
- Should an account be closed, cancelled or terminated for any reason, all unbilled usage charges remain payable and will be invoiced after the account is closed, cancelled or terminated.
- Should your Concours Pro phone number(s) be deleted for any reason there are no refunds for unused portions of monthly number rentals. You may re-acquire them at the current rates, but we cannot guarantee that the same phone numbers will be available and we are not liable for any expenses, damages or loss of business as a result of deleting phone numbers.
- When sending / receiving SMS / MMS to and from USA and Canada, you may be charged carrier fees which will appear on your usage invoice. SMS and MMS carrier fees are typically small surcharges applied by the various North American mobile carriers on certain types of incoming or outgoing message traffic.
2.3 Payment Terms
- Should an account be cancelled, or terminated there will be no refunds of the current months subscription fee already paid.
- Should an account with an active minimum commitment period or discounted rate be cancelled, pro-rata refunds, credits, or waivers will be be provided minus any discounted amounts across the timeframe of the agreement, the current months subscription fee, and any reasonable penalty fee and/or admin costs, where the admin cost / penalty fee is not exceeding 1 months undiscounted subscription rate.
- All subscription payments are processed on a credit / debit card by Stripe Payments Australia Pty Ltd (‘Stripe’) at stripe.com.
- By signing up for a paid subscription, you agree to the terms of Stripe.
- Users can access the Stripe billing dashboard to update payment methods and billing details by clicking the ‘Manage Subscription’ link the platform sidebar, or visiting: https://juicedigital.com.au/concours-pro-billing/
- From time to time, additional one-off fees (e.g. setup, design, custom integrations) may apply.
- These fees are invoiced separately and must be paid within 14 days.
- If a scheduled subscription payment fails, Stripe Payments Australia Pty Ltd will automatically retry the payment up to 8 times in 1 week.
- The user will be notified upon the first failed payment on the due date and given opportunity to remedy by updating the current payment method.
- If a subscription, usage invoice or one-off invoice remains unpaid for 1 week after the due date, the account will be suspended and access to the platform will be unavailable.
- If a subscription, usage invoice or one-off invoice remains unpaid for a period of 4 weeks, the user will be notified of impending referral to a debt collection agency when the debt reaches 6 weeks unpaid.
- If a subscription, usage invoice or one-off invoice remains unpaid for a period of over 6 weeks, the debt may be referred to a collection agency, with recovery costs, limited to our documented admin fees and third-party costs, payable by the client.
2.4 Free Trials & Free Account Setup Offers
- A limited number of Free Trials and Free Account Setups are available each month.
- All Free Trial offers and Free Account Setup offers are at our discretion, and the offers thereof may be withdrawn at any time.
- We guarantee to not withdraw any active free trials unless there is a breach of these terms by the user.
- Only one free trial per applicant. If your free trial is cancelled, not completed, or doesn’t progress to a full account, no replacement free trial is available.
- To take up the free account setup offer, you must opt-in by clicking the link in your welcome email, AND also submit the Free Trial Onboarding Questionnaire within the specified timeframe.
- If Free setup is requested OR the Onboarding Questionnaire is submitted after the specified timeframe, the setup can still be completed, but will be subject to setup fees.
- The free account setup offer is only for Business Essentials level features as follows:
- Basic setup and configuration of all Business Essentials level features is included unless excluded below.
- Integrations limited to one each of the following: MS365, Google, Paypal, Stripe and All Social media scheduler accounts.
- Invoicing setup is limited to basic business and invoice setup – Products and services set up / import excluded.
- CRM setup is limited to maximum 20 custom fields of the standard types.
- Calendar setup is limited to one calendar integration and setup of one personal (one-on-one) calendar.
- The following features are excluded from free setup:
- Voice AI.
- Content AI.
- Forms (Except for one calendar booking form).
- LeadConnector WordPress Plugin.
- Apps from the App Marketplace
- Dedicated domain setup.
- Media library setup & imports.
- Google Business Profile Optimisation.
- You may be required to book an onboarding call, when requested, to complete your free setup. For example, when requesting set up of features requiring passwords to complete integration.
- Failure to book a requested onboarding call within the advised timeframe will result in your free account setup being considered completed, and your account handed over as-is.
- Failure to submit all required details for features selected to be set up as part of a free set up offer will result in those features not being set up, and your account being handed over as-is.
- Any setup work requested after the account is handed over will be subject to setup fees.
- Custom account setup agreements may be offered on a case by case basis and will override these terms.
2.5 Subscription Changes and Cancellation
- You can change your subscription level through the billing portal. Any differences in the monthly rate will be charged or credited, pro-rata to the end of your billing cycle, which will remain the same. Credits will remain on your account and will not be refunded.
- If you choose to change your subscription level during a free trial, this will automatically end the free trial, and you will be charged the monthly rate at that time, and that date will be the start of your new billing cycle.
- Cancellation can be requested through the billing portal, and will result in immediate loss of all access, features and services, and immediate deletion of all phone numbers associated with your account.
- All remaining data may be deleted after 6 weeks, unless legally required otherwise. You will not have access to your data unless we are legally required to grant access.
3. Platform Use & Ownership
3.1 Use of Concours Pro
- You must use Concours Pro in compliance with applicable laws and regulations.
- Only authorized users may access the system. You are responsible for maintaining the security of your login credentials.
- You agree not to use, copy, modify, or distribute any part of Concours Pro without written permission.
3.2 Intellectual Property & Platform Ownership
- Concours Pro remains the property of its respective rights holder.
- Your subscription grants you a license to use the platform, but does not transfer ownership of the underlying software, frameworks, or system architecture.
- Any custom configurations, branding, or additional design work provided as part of your setup remain your property upon full payment.
3.3 Data Safety & Backups
- Our platform partners implement industry-standard security measures to protect your data, but we do not guarantee against unauthorized access or data loss.
- We recommend that you perform regular backups of critical data.
- To the extent permitted by law (including the Australian Consumer Law), we are not liable for data loss or security breaches beyond our reasonable control.
3.4 Acceptable Use Policy (AUP)
By using Concours Pro, you must comply with all applicable laws and regulations and agree not to engage in any prohibited activities, including but not limited to:
- Any content, activity, or behaviour that involves or promotes the exploitation or harm of minors in any form. This is strictly prohibited and will be reported to law enforcement without notice.
- Any content, activity, or behaviour that is illegal, fraudulent, or considered unethical.
- Uploading, storing, sharing, or distributing explicit adult material or content that depicts sexual acts, nudity, or any similar material.
- Spamming, phishing, or sending unsolicited marketing messages.
- Hosting, sharing, or promoting hate speech, violence, terrorism, or illegal activities.
- Hacking, unauthorized access, or attempts to disrupt the platform or compromise user accounts.
- Impersonating any person or entity without authorization.
Juice Digital enforces a ZERO-TOLERANCE policy on content violating our AUP involving minors, explicit adult material, or illegal activities. Any violation may result in immediate and possibly permanent account suspension without notice.
4. Account Suspension & Termination
4.1 Suspension & Termination
- We may suspend or terminate your account immediately, without notice, if you violate these Terms of Service including our AUP. We will provide evidence of the violation and you will be able to start an immediate appeal process by contacting our support team.
- We may suspend your account immediately, if you fail to make a payment within the required timeframe. You will receive notification of failed payments on the subscription due dates, and notification of overdue invoices once they become 1 day overdue.
- Account suspensions will be advised by email, with an associated timeframe or notice of indefinite suspension pending investigation, or payment of overdue amounts.
- Suspensions may be appealed by reply to the notification email, or contacting our support team. All decisions regarding account suspensions are final and are at our discretion.
- We may offer at our discretion compensation for overturned suspensions that the user can reasonably prove were unfair or wrongful. Compensation will be limited to a credit equal to 3x the current months subscription rate.
- If your account is suspended for non-payment, your access to Concours Pro will be revoked until payment is received.
- If your account is suspended for violation of our Terms of Service or AUP, your access to Concours Pro will be revoked until our investigations are complete, and a suitable suspension term of our choosing has been served. We may opt to not restore your access until we receive written assurances of future compliance with the terms of service and AUP.
- If your account is terminated for violation of our Terms of service or AUP, or for continued non payment your data may be deleted after 6 weeks, unless legally required otherwise. You will not have access to your data unless we are legally required to grant access.
- Suspended accounts will have no access to the platform or any data within.
- If an account is suspended, usage rates will continue to be charged for paid features that accrue active usage and provide ongoing benefits while suspended, such as phone number monthly rentals (to retain access and prevent loss of the number) and incoming SMS (to preserve messages and potential leads for access upon restoration), or A2P charges (USA phone numbers only).
- During suspension, you may opt out of ongoing usage charges by requesting deletion of your phone numbers by contacting support; we will delete them to stop usage charges, as of the time of receiving your request, but you must reacquire and reconfigure all deleted phone numbers upon unsuspension at standard rates, and you will still be billed any usage incurred before opting out. We do not guarantee the same phone numbers will be available to re-acquire on unsuspension, and we are not liable for any expenses, damages or loss of business as a result of deleting phone numbers in this way. Opt-out is not available for AUP violations.
4.2 Enforcement
- If an account is suspended or terminated for any reason, your monthly billing cycle remains unchanged, and all outstanding payments, including minimum commitment obligations, will remain payable in full to maintain service continuity benefits where applicable.
- Account suspensions or terminations do not void contractual payment commitments.
- Juice Digital reserves the right to take further legal action against users who breach these Terms of Service.
5. Dispute Resolution
- If a dispute arises, both parties agree to first attempt resolution through direct negotiation.
- If unresolved within 14 days, the dispute will be referred to mediation.
- If mediation fails, binding arbitration under ACICA (Australian Centre for International Commercial Arbitration) rules will apply, with costs split unless otherwise awarded.
- Arbitration is the primary method for resolving disputes, with any awards enforceable through the NSW courts.
6. Modification of Terms
- We may update these Terms of Service at any time by publishing new versions here.
- We reserve the right to modify subscription levels, available features and subscription pricing with 30 days notice to the user.
- Changes will take effect after 30 business days unless the user formally objects in writing, in which case they have the right to cancel their subscription without penalty. Unbilled usage will be invoiced as above.

7. Governing Law & Jurisdiction
- These Terms of Service are governed by the laws of New South Wales, Australia.
The courts of NSW have exclusive jurisdiction for the enforcement of arbitration awards and any matters not subject to arbitration.
